THE DIVISION OF POWERS AND LEGISLATIVE SUPREMACY IN JOHN LOCKE’S “SECOND TREATY ON GOVERNMENT”

The present work aims to discuss the topic to outline problems regarding the foundations of contemporary democratic ideology, forms of government, the consensus regime (read: constitutional), the majority principle and representativeness, the legality of the power of social peace, individual freedom conditioned by the legal system and the problem of human rights and the exercise of citizenship. As for the theoretical, methodological options and excerpts, this work, being eminently bibliographic, has as its fulcrum the Two Treatises on Government, by John Locke, notably, the Second Treatise on Government, as well as the explanatory studies related to the topic. The work seeks to corroborate the hypothesis that John Locke's Political Theory makes sense despite the difficulties of asserting the supremacy of the Legislature in the face of the other powers of the Democratic Rule of Law.
